Is your paycheck at risk?

On Behalf of | Jul 31, 2017 | Child Support |

If you’re one of many Kentucky parents whose marriages went sour and ended in divorce, you’re definitely not alone. Like most parents in this and all other states, you want what’s best for your kids, and you may have worried about their overall well-beings regarding how they would take the news of your divorce and whether they’d be able to successfully adapt to new lifestyles. Thankfully, there are support networks available to help families like yours as the divorce process takes place and a new future unfolds.

There are probably several issues that created challenges for you as you forged a path to a post-divorce life. If your situation is similar to many others who have trod such paths in the past, a main topic of concern was likely child support. This is often a hot-button topic that evokes strong emotions on both sides.

Are you worried about wage garnishment?

In a fluctuating economy, someone with good financial standing may come upon hard times when least expected. If you are obligated to pay child support, even a slight change in finances may create serious obstacles that make meeting your financial obligations difficult. The court sometimes orders that money be directly taken out of a paycheck to satisfy a debt. If your earnings are at risk, the following information may be helpful:

  • It’s often possible to work out alternate arrangements if you’re no longer able to keep up with your current child support payments.
  • If necessary, you may request a modification of your child support order. This is a formal request submitted to the court.
  • Wage garnishment is not something that can unexpectedly take place. It requires a court hearing.
  • Both federal and state governments typically provide employee protection that prohibits any wage garnishment that would leave a worker impoverished.
  • Your employer must notify you if wage garnishment is about to begin.

If, for some reason, you are unable to meet your child support payments, you undoubtedly will want to address the situation with appropriate officials as soon as possible to avoid problems, especially wage garnishment. In fact, this option is often a severe consequence of lingering outstanding debt situations, perhaps involving other issues in addition to child support, such as back taxes and/or credit card debt. Sometimes such issues are interwoven in child support problems.

It often helps to have an advocate by one’s side when addressing wage garnishment issues in court. One person who may be able to help find agreeable solutions to child support problems is an experienced Kentucky family law attorney.
